These Terms constitute the terms and conditions referred to in Art. 8 of the Polish Act of 18 July 2002 on Providing Services by Electronic Means.
The service provider and seller is Future by Life sp. z o.o., registered office at ul. - Entrepreneur with consumer status – a natural person concluding a contract directly related to their business activity where the contract shows that it is not of a professional nature for that person, in particular as follows from the subject of their business activity disclosed in the Central Register and Information on Economic Activity (CEIDG) (Art. 7aa and 38a of the Polish Consumer Rights Act and Art. 556⁴–556⁵ of the Civil Code);
- Verified professional – a Customer whose professional status has been confirmed by the Seller on the basis of submitted documents;
- Verified physician – a Verified professional with a confirmed licence to practise as a physician or dentist;
- Products – devices (including diode and hybrid lasers, HIFU and RF devices), consumables, preparations and training courses offered on the Portal;
- Rx products – medicinal products or other products whose purchase or use is restricted by law to physicians;
- Club – a closed, moderated professional community available to Verified professionals.
§ 3. Types and scope of electronic services
The Service Provider provides the following electronic services free of charge:
- maintaining a Customer account (sign-in exclusively via a Google account);
- browsing the Product catalogue and knowledge base;
- enquiry form and contact form;
- placing orders for Products and registering for courses;
- access to the Club for Verified professionals;
- downloading materials (e.g. checklists) made available on the Portal.
The contract for the account service is concluded upon first sign-in and acceptance of the Terms, for an indefinite period. Contracts for other services are concluded for the duration of their performance (e.g. submitting a form).
§ 4. Technical requirements
- a device with Internet access;
- an up-to-date web browser (e.g. Chrome, Firefox, Safari, Edge) with JavaScript and strictly necessary cookies enabled;
- an active Google account – to sign in;
- an active e-mail address;
- software capable of opening PDF files – to read documents.
The Service Provider points out specific risks associated with using the Internet, such as malware, phishing or interception of data, and recommends using up-to-date anti-virus software and securing your Google account with two-factor authentication.
§ 5. Customer account and verification
Sign-in to the Portal is possible exclusively via Google (OAuth 2.0). The Customer must complete the professional profile with true data (profession, company, NIP, phone, address, licence number) and keep it up to date.
To access professional Products, Rx products or the Club, the Customer uploads documents confirming their qualifications. The Seller verifies the documents within 5 business days and may refuse verification if the documents are insufficient or raise doubts.
The Customer may delete the account at any time on the "My account" page and download an export of their data in JSON format. Deleting the account does not affect contracts already concluded or the Seller's obligation to retain accounting documents.
The Seller may suspend or delete a Customer account in the event of a serious breach of the Terms or the submission of false data or documents, after first requesting that the breach cease, unless the nature of the breach justifies immediate action.
§ 6. Prohibition of unlawful content and Club rules
The Customer undertakes to use the Portal in accordance with the law, good practice and these Terms, and in particular not to provide unlawful content, including content infringing personal rights, copyright, medical confidentiality or patients' personal data (published cases must be anonymised and published with the patient's consent), content advertising medicinal products or medical devices unlawfully, or misleading content.
Club content is moderated. The Seller may remove content that infringes the Terms or the law and notify the author, stating the reasons. Reports of illegal content may be sent to kontakt@futurebylife.pl; they are handled promptly, taking into account the requirements of Regulation (EU) 2022/2065 (Digital Services Act) to the extent applicable.
§ 7. Customer scope of sales (B2B)
The Portal's offer is addressed exclusively to businesses and professionals. The Portal does not sell to consumers within the meaning of Art. 22¹ of the Polish Civil Code. By placing an order, the Customer declares that it acts in connection with its business or professional activity.
Devices that are medical devices and professional equipment are sold only to Customers holding appropriate qualifications to operate them, in accordance with the intended purpose defined by the manufacturer. Rx products are sold only to Verified physicians. The Seller may refuse to fulfil an order if the Customer does not meet these conditions.
§ 8. Prices
Product prices are shown in Polish zloty or another selected currency as net prices, to which VAT at the applicable rate is added. The gross price and delivery costs are shown before the order is placed or in the offer / pro-forma invoice. Prices converted to another currency are for information only; the price stated in the pro-forma invoice is binding.
Product information on the Portal does not constitute an offer within the meaning of Art. 66 of the Civil Code but an invitation to conclude a contract (Art. 71 of the Civil Code).
§ 9. Conclusion of contract
- the Customer places an order via the Portal or submits an enquiry;
- the Seller sends a confirmation of receipt of the order and a pro-forma invoice stating the price, delivery costs, lead time and payment deadline;
- the contract is concluded when the Customer accepts the pro-forma invoice (e.g. by paying it or confirming it by e-mail);
- the content of the contract is recorded and made available to the Customer by e-mail and in the Customer account.
§ 10. Payments
Payment is made by bank transfer on the basis of a pro-forma invoice to account stated on the pro-forma invoice (or online via Stripe) within the deadline stated in the invoice. Once payment is received, the Seller issues a VAT invoice. If payment is not made on time, the Seller may withdraw from the contract after setting an additional deadline. The Seller may agree individual payment terms with the Customer (e.g. partial prepayment, leasing).
§ 11. Delivery, installation and training
Delivery is made within Poland and, by agreement, to other EU countries by carrier or by the Seller's own transport. The delivery date is stated in the pro-forma invoice. At the Customer's request the Seller may install the device and provide operator training under the terms set out in the offer.
The Customer should inspect the shipment upon receipt in the presence of the carrier and, in the event of damage, draw up a damage report. Upon handing over the Product to the carrier, the benefits and burdens and the risk of loss or damage pass to the Customer (Art. 548 § 1 and Art. 544 § 1 of the Civil Code), subject to the provisions on entrepreneurs with consumer status.
Detailed terms of course participation (date, venue, cancellation terms) are set out in the course description and the registration confirmation.
§ 12. Statutory warranty (rękojmia) and guarantee
Customers who are businesses
Pursuant to Art. 558 § 1 of the Civil Code, the Seller's liability under the statutory warranty (rękojmia) towards Customers who are businesses is excluded, without prejudice to liability under the manufacturer's or Seller's guarantee. The guarantee terms, period and scope of device service are set out in the guarantee card supplied with the Product.
Entrepreneurs with consumer status
The exclusion of the statutory warranty does not apply to entrepreneurs with consumer status. They have rights in respect of lack of conformity of goods with the contract under Chapter 5a of the Polish Consumer Rights Act of 30 May 2014 (Art. 7aa of that Act) – in particular the right to request repair or replacement and, in certain cases, a price reduction or withdrawal from the contract. The Seller is liable for any lack of conformity existing at the time of delivery and becoming apparent within two years of that time.
The complaints, returns and service procedure is set out in the Complaints and Returns Policy.
§ 13. Right of withdrawal
Customers who are businesses do not have a statutory right to withdraw from a distance contract. An entrepreneur with consumer status may withdraw from the contract within 14 days without giving any reason (Art. 27 in conjunction with Art. 38a of the Consumer Rights Act), subject to the exceptions in Art. 38 of that Act, in particular for sealed goods which are not suitable for return due to health protection or hygiene reasons once unsealed, and goods made to the Customer's specifications. Details are provided in the Complaints and Returns Policy.
§ 14. Complaints about electronic services
Complaints about the operation of the Portal can be sent to kontakt@futurebylife.pl or in writing to the Seller's registered office. A complaint should contain the Customer's details and a description of the problem. The Seller handles the complaint within 14 days of receipt and informs the Customer of the outcome electronically.
§ 15. Intellectual property
The Portal content, including articles, training materials, checklists, graphics and Club recordings, is protected by copyright. Copying and distributing it beyond permitted use requires the consent of the Seller or the entitled author.
§ 16. Liability
Knowledge base and Club content is informational and educational and does not replace the manufacturer's documentation, device operator training or individual legal or medical advice. In relations with Customers who are businesses, the Seller's liability is limited to actual damage and to the price paid for the Product concerned, except for damage caused intentionally. This limitation does not apply to entrepreneurs with consumer status to the extent that it would conflict with mandatory provisions of law.
§ 17. Personal data
The rules for processing personal data are set out in the Privacy Policy and the rules for using cookies in the Cookie Policy.
§ 18. Governing law and dispute resolution
Contracts concluded via the Portal are governed by Polish law, in particular the Civil Code. Disputes with Customers who are businesses are resolved by the court having jurisdiction over the Seller's registered office. The choice of law and court does not deprive an entrepreneur with consumer status of the protection afforded by mandatory provisions of law.
§ 19. Amendments to the Terms
The Seller may amend the Terms for important reasons (e.g. changes in law, changes in the scope of services, security considerations). Signed-in Customers will be informed of the changes at least 14 days in advance. Contracts concluded before the change are governed by the previous version of the Terms.
Version: 2026-10. These Terms apply from 29.10.2026.
